Terms and conditions for the use of Keytrade Bank's Internet site (www.keytradebank.com)

Any person accessing the Keytrade Bank Internet site (hereinafter the "user") is presumed to have accepted these terms and conditions for the use of Keytrade Bank site.

1. Utilisation rights and obligations

The information disseminated and the tools offered on the site may only be used by users for personal purposes, in a normal and reasonable manner, and exclusively for the purposes for which the information is made available.

2. Property rights, notably intellectual property rights

Each user of the site acknowledges that the information, images and data published on the site in any form whatsoever are and shall remain the property of Keytrade Bank and/or its suppliers and undertakes not to publish, disseminate, use, transform, alter, or reproduce them, in full or in part, in any manner whatsoever and in any form whatsoever, without the prior express written consent of Keytrade Bank. This stipulation covers the content of the site and its components, as well as its form, presentation, structure and general "look and feel".

The marks, appellations and logos, whether or not registered, present on the site are the exclusive property of Keytrade Bank or other companies and cannot be used or reproduced.

No element of this site may be interpreted as being an assignment of property rights, notably intellectual property rights, to the site's user.

3. Liability

Keytrade Bank makes available to the user, within the limits of these terms and conditions of use, its Internet site, its functions and the information contained therein. The user is aware of the fact that most of the information, data, tools and functions on the Keytrade Bank site are only accessible to clients of Keytrade Bank who have entered into a banking relationship with Keytrade Bank and may access these functions and information via confidential and personal codes provided to them by Keytrade Bank. The general terms and conditions of Keytrade Bank and/or other specific contracts concluded by Keytrade Bank with its clients shall prevail over these terms and conditions of use.

Keytrade Bank may decide at any time to modify its site or the functions, tools and information available on its site and cannot incur any liability vis-à-vis the site's users as a result of these changes. Keytrade Bank does not undertake in any way to maintain the products and services available on its site and may decide at any time to remove or modify the products and services contained on its Internet site, without incurring any liability vis-à-vis the site's users. The site and its components cannot be considered as an offer of products or services from Keytrade Bank nor as a means to sell or purchase banking, financial, insurance or other products or services. This site is merely intended to provide information to users, and Keytrade Bank is free to modify it at any time. Users of the site and clients are informed that the entity responsible for processing information of a personal nature is Keytrade Bank SA, having its registered office at Vorstlaan-Boulevard du Souverain 100, 1170 Brussels. 4.1. Information gathered from the site's users

Keytrade Bank may, as the case may be, process the information gathered from the site's users during a visit to the site in accordance with the law of 8 December 1992 concerning the protection of personal information. The processing will be carried out for the purposes of managing services for which the user has introduced its personal information or for the purposes of advertising or marketing. The information will not be transmitted to third parties. It is pointed out that the user is entitled to refuse the use of its information for direct marketing purposes, in accordance with the formalities set out in those areas of the site where information that may be processed for direct marketing purposes is gathered. 4.2. Information gathered from clients

As indicated in Article 20 of Keytrade Bank's general terms and conditions, data of a personal nature relating to the client, especially data relating to that client's identity, place of residence, personal status and assets and to the operations concerning him, shall be recorded in one or more of Keytrade Bank's files in accordance with legislation applicable in Belgium. In application of the Law relating to the protection of privacy, the client is herewith informed that the "processing manager" is Keytrade Bank SA, whose registered office is at Vorstlaan-Boulevard du Souverain 100,1170 Brussels.

By accepting the general terms and conditions, the client has indicated that he agrees to his data being recorded and processed by Keytrade Bank for administrative purposes, for account management purposes, operations management, the management of contractual relations, ensuring that operations are properly carried out and irregularities prevented, compiling statistics and tests, and commercial canvassing and direct marketing in relation to banking, financial and insurance products, or other products promoted by Keytrade Bank. Keytrade Bank may also use the client's data for marketing products and services offered by third parties, although Keytrade Bank shall not permit the communication of the client's data to these third parties.

The client has also indicated that he agrees to Keytrade Bank's communicating personal data relating to him to companies linked to or belonging to the group of which Keytrade Bank is a part. The client acknowledges and, in so far as is necessary, accepts that Keytrade Bank may be required, in accordance with current legislation, to communicate certain information or documents on clients, their accounts and operations carried out by them to the market authorities, the Banking, Finance and Insurance Commission, similar authorities abroad, and generally speaking to any legal or administrative authority. This agreement shall also apply if data is communicated to the persons listed above in a country that is not a member of the European Union but guarantees an adequate level of protection.

The client shall have the right to object to the processing of his data for commercial canvassing or direct marketing purposes free of charge, by sending an e-mail to the following address: legal@keytradebank.com.

The client has the right to consult his own data and to obtain correction of inaccurate data. For this, the client has to send an email to legal@keytradebank.com

4.4. Use of cookies

The nullity or invalidity of a provision in these conditions of use shall not affect the validity of the other provisions of these conditions

These conditions of use are governed by Belgian law. In the event of a dispute, the courts of Brussels (and, notably, the "justice de paix/vrederechter" of the legal district of Keytrade Bank's registered office) shall have sole juridiction.
